The Legal Status of Gig Workers in the Creative Industry as Workers in Indonesia

Abstract

This research aims to provide knowledge and analyze the legal status certainty of gig workers in the creative industry sector in the digital economy era. Creative industry gig workers still face various challenges, including minimal social protection and vulnerability to harmful practices by digital platforms. The results of this research show that the legal position of creative industry gig workers based on the Labor Law in Indonesia is as workers under Fixed-Term Employment Agreements, because they fulfill the elements of employment relationships in accordance with Article 1 number 15 of the Labor Law, namely the elements of work, wages, and orders.
